WIDOW OF DECEASED WORKER
TO HAVE HER DAY IN COURT!

Attorney Louis N. George of the law Firm of Hassett & George, P.C. was successful in his representation of a Widow of a deceased worker who allegedly died from a work related exposure to toxic radiation. The Workers’ Compensation Commissioner denied the Employers’ Motion to Dismiss, the worker’s compensation claim has been pending since 2001. The denial allows the client to proceed on the merits. Finally, after many years of fighting, our client will have her day in court!

Attorney Louis N. George recently argued an appeal to the Connecticut Supreme Court seeking to overturn the decision of the Trial Court which dismissed the complaint by David and Shaun Wilcox against Defendant Arcadia Insurance Company for lack of standing.

HASSETT & GEORGE, P.C. LAND USE TEAM SUCCESSFUL IN AUTOMOBILE DEALERSHIP APPROVALS!

Louis N. George led a team of experts in the approval of two necessary land use applications allowing an Automotive Repair and Sales business to relocate in the Town of Simsbury. The process required a Zone change and a Special Exception Permit from the Zoning Commission, and further, a referral from the Planning commission. After three hearings and a site walk the Town unanimously approved the project which will not only benefit the Automobile Dealer but the Town of Simsbury.

 

HASSETT & GEORGE, P.C. PREVAILS IN AN EMPLOYMENT DISCRIMINATION CASE!

A Federal Court has recently dismissed a civil discrimination lawsuit against a company represented by Hassett & George, P.C.

The corporate client, C&D Security, is responsible for armed security in Federal Courthouses and other federal buildings. The Company was accused of violating the Americans with Disabilities Act (ADA) and Connecticut Worker’s Compensation Act, as well as other related claims.

The Attorneys at Hassett & George successfully briefed and argued to the Court that the Plaintiff’s claims were both legally and factually inaccurate.

The C&D Human Resource Director told the Hassett & George Attorneys that everyone including “the Executive Vice President and Owners of the company were extremely pleased when they received the copy of the Court’s decision.”

The Plaintiff alleged that the employer wrongfully failed to hire him based on violations of the ADA, and State of Connecticut Worker’s Compensation laws. The Plaintiff also asserted a personal liability claim against one of the Company’s manager alleging he aided and abetted the Company with the willful violations. If this were not enough, the Plaintiff also claimed a former employer was also involved and liable for the alleged illegal acts. Attorneys at Hassett and George, P.C. analyzed the Plaintiff’s numerous claims and vigorously defended the matter. The defense ultimately convinced the Court, at an early stage in the case, that the C&D had done nothing wrong.

The case was handled by Attorneys Raymond Hassett and David Bondanza.

ANOTHER EMPLOYMENT VICTORY
FOR A CLIENT OF HASSETT & GEORGE, P.C.

An International Union representing employees of a client of Hassett & George, filed a grievance alleging prohibited discipline imposed upon its Union’s President for malfeasance while on the job. The grievance alleged three issues.

  1. A one-week suspension and one-year probation period imposed was an excessive punishment;
  2. That the company had no just cause to discipline him, and;
  3. That the company failed to timely impose the discipline.
Hassett & George defended the employer at the arbitration hearing. Multiple witnesses were offered to establish that punishment was appropriate and not excessive, the company had just cause to impose discipline, the issue of just cause was not arbitrable, and that the company had complied with the timing provisions of the Collective Bargaining Agreement.

The Hassett and George, P.C. team prevailed and by written decision the arbitrator denied the Union’s grievance, in its totality.

HASSETT & GEORGE, P.C. LAND USE PRACTICE SUCCESSFULLY OBTAINS SPECIAL PERMIT!

The land use group of Hassett and George, P.C. was successful in obtaining a special permit for crushing and recycling aggregate for one of its construction and trucking Clients. While the federal government prepares to disperse billions of dollars in road construction projects, our clients have been preparing for providing products to meet the demands for those projects.

Despite objection from competitors and concern among the land-use board the special permit was ultimately approved in part because of the advocacy of Hassett & George, P.C. Attorneys. This facility will help our client succeed even in this economy.

 

IN A DOWN ECONOMY HASSETT & GEORGE, P.C. ATTORNEYS ARE GETTING THE DEALS DONE!

Although the economy is still fragile and lending institutions are tight with their loans, the Commercial Transactional Department at Hassett and George, P.C. has had a very busy spring. In May the Commercial Transactional Department closed multiple multimillion dollar commercial transactions.

The first was for a construction loan to facilitate construction of two buildings in a multi-use office complex. The first building will be a two story office building and the second building will be a large day care center.

Attorney George notes that "it is good to see that developers are still able to obtain financing and continue construction during this bad economy."

The second transaction involved the refinancing of a large condominium project with over 100 unites in southeastern Connecticut.

The restructuring helped to lower the operating costs while insuring that funds to complete the project will be available despite the condition of the housing market. The developer has had numerous inquires from potential homeowners who have indicated an interest in purchasing new construction.

Hassett and George, P.C. Attorneys have also assisted clients in purchasing attractively priced commercial parcels for development and have successfully brought to conclusion the purchase of a parcel to be renovated into a medical office complex.

 

HASSETT & GEORGE, P.C. MEDICAL PRACTICE CLIENT MAINTAINS ITS CASE OVERCOMING A SHRINKWRAP LICENSE IN MEDICAL BILLING SOFTWARE!

Advocacy by the Attorneys at Hassett and George, P.C. convinced the Court that a denial of a Motion to Dismiss of their client's breach of contract claims was proper.

The Motion to Dismiss was based on a forum selection clause contained in documents that were not received until after a purchase of computer software by a small medical practice was complete. The Defendant, claiming to have hundreds of clients held the position that the "shrink wrap license agreement" housing the forum selection clause required the parties to have their dispute heard in another another state.

The Attorneys at Hassett and George, P.C. analyzed the case history of the computer software industry and the concept of "shrink wrap" and "click wrap" licenses. They successfully distinguished the factual background in the case and convinced the Court that the case not only could be heard by a Connecticut Court, but should be heard here as the principals of the medical practice had no idea there were additional terms to the contract they entered into at the time they purchased the software.

 

HASSETT & GEORGE CONSTRUCTION CLIENT RECOVERS $125,000.00 IN A CONTRACT DISPUTE!

The Attorneys at Hassett and George, P.C. recently recovered over $125,000.00 of a client's money through swift action by its collections practitioners when they negotiated a structured payment schedule to resolve the matter minutes before a pre-judgment remedy hearing was to commence.

To secure the settlement, the Hassett & George Attorneys attached local and foreign real estate.

With the settlement secured, the monies have been paid on time and in full.

 

HASSETT & GEORGE CORPORATE CLIENT PREVAILS BEFORE THE CONNECTICUT COMMISSION ON HUMAN RIGHTS AND OPPORTUNITIES

Hassett & George, P.C. successfully defeated a claim of discrimination against one of its corporate clients, filed with the Connecticut Commission on Human Rights and Opportunities (CHRO). The claimant alleged discrimination against her employer on the basis of gender and pregnancy. Following a hearing with multiple witnesses, the CHRO representative found in favor of the employer. The case was successfully handled by Attorney Raymond M. Hassett.

ATTORNEY HASSETT REPRESENTS JUDGE COFIELD BEFORE THE JUDICIAL REVIEW COUNCIL

Attorney Raymond M. Hassett recently represented the Honorable Judge E. Curtissa Cofield before the Judicial
Review Council in connection with charges levied against her subsequent to a motor vehicle accident.
The Judge was suspended for 240 days.

The Judicial Branch has developed a DVD entitled, Putting Children First: Minimizing Conflict in Custody Disputes, to help families involved in custody disputes. Judge Elaine Gordon, who handled family cases as a lawyer and now presides over custody cases, is featured on the video. The goal of the presentation is to help parents understand, early in the process, the harm that conflicts over custody can do to their children; and that the fight itself can cause the most damage.

JURY DEADLOCKED – MISTRIAL DECLARED BY JUDGE

Attorney Raymond M. Hassett recently concluded a two month trial in defense of David Wilcox, owner of
American Crushing & Recycling, LLC. Mr. Wilcox has been charged with Larceny and Insurance Fraud
in connection with a tragic motor vehicle accident at the base of Avon Mountain on July 29, 2005. The
accident resulted in four fatalities and numerous injuries. The recent trial resulted in a hung jury
due to an even 3-3 split and therefore, an inability to reach a unanimous verdict. A mistrial was declared.

The trial was the first trial in the State of Connecticut to be televised under a new experimental pilot program.

Driver’s License Successfully Reinstated

Attorney Hassett recently attended a Department of Motor Vehicle Suspension Hearing and successfully
reinstated driving privileges of a client accused of operating a motor vehicle under the influence.

Attorney Hassett argued that the police report in this case was defective and driving privileges could not be suspended.

At the conclusion of the hearing, the DMV Hearing Officer agreed and immediately reinstated the driver’s operating privileges.



Litigation Team Retained to Handle Two Multi-Million Dollar Workouts

Hassett & George, P.C. was retained to represent two separate businesses for commercial workout litigation.

One business is a manufacturing company and one is a retail establishment with seven stores in multiple states.

Attorneys from Hassett & George P.C. worked with creditors to allow one of the businesses to continue operation while resolving all financial issues.

The second business was in the midst of a merger but could not complete the process until the creditors were satisfied.

Both of these matters required both an understanding of the legal issues and more importantly the business issues to allow both clients to reach their goals.



Land Use Issue

Louis N. George successfully discharged a mechanics lien which had been fraudulently placed on the land records of their clients property.

Not only was the lien discharged but the team at Hassett & George P.C. were successful in obtaining thousands of dollars in costs reimbursed to the client.

Louis George continues to serve as the Chairman of the Simsbury Economic Development Commission and on the Zoning Board of Appeals for the Town of Simsbury.

The Commission is responsible for retaining existing businesses and attracting new businesses to the Town.

Additionally, Lou has been able to tap into his land use experience to assist his Town in various zoning and land issues.

Attorney Hassett continues to serve on the Alumni Board of Governors for the Catholic University of America, located in Washington, D.C. Mr. Hassett will participate in coordinating and developing University policy and alumni relations.

Attorney Hassett and his Wife addressed a gathering of approximately 100 engaged couples in preparation for marriage.

The four day long gathering addressed financial, emotional and psychological issues likely to be seen in marriage.

The engaged couples encounter is a prerequisite to marriage in the Roman Catholic Church in the Hartford Archdiocese. Clergy also spent time addressing the issue of religion and its involvement in marriage.

Attorney Hassett was the keynote presenter at a seminar in Hartford and New Haven, on the Equitable Distribution of Marital Property.

The seminar addressed the latest issues in marital property distribution, as well as the valuation of the parties' debts and assets. The seminar will be attended by attorneys, financial analysts and other experts who deal with the issues of valuing and distributing marital property.
